Who should pay credit card surcharge fee during holiday cancellation?

Hi All, I have recently cancelled my holiday due to various reasons and the tour operator agreed to cancel the holiday and refund the payment. However they told that they will not refundthe credit card surcharge fee as I paid for the holiday using credit card for section-65 protection. And I also have a valid travel insurance. So, the question is who should be paying the credit card surcharge fee which is a significant amount - Is that the tour operator or the credit card company or Travel insurance? Any help would be appreciated. Thanks. Regards Vinod.
