Is there a mortgage for a non owner divorcee living in the ex marital house with a dependant?

Hi there, my still husband owns our house, my name is not on the deeds or the mortgage. I need to know what to do if I want to stay living in the house. I'm just toying with the idea because I don't have enough info about this.

    When you divided the marital assets for the divorce settlement, was the equity in the house, if any, taken into account? If so, who received it?

    Could you take on the mortgage on your own income? The bank/BS would consider it as a new application.

    He would be part responsible for any child and part of that expense would be to contribute towards the cost of accommodation for the child.

    Hi Mike,

    Unfortunatelly divorce hasn't even started yet. I have an occupational order lasting 12 months to live in the house but any day the divorce should commence.

    I am currently unemployed but doing all I can to get a part time job in admin as it'd be difficult to work full time (no family to help with looking after my daughter who's 3,5 y-o, next year a shool goer).

    I have until November next year to stay safe here. I don't want to move for my daghter only lived here but that's probably just my sentiment, I feel.

    So you have the occupational order which lasts until November and your daughter presumably starts school in September. Maybe then you could get a full-time job if there are after school clubs. That would give you a 2 month overlap.

    The ownership of the house should be sorted out as part of the divorce settlement. The equity in it will be part of the matrimonial assets to be divided. Until then, it is too early to make any suggestions. If the settlement drags on you might be able to have the occupational order extended.

    Any mortgage that you take on afterwards would be on the basis of your then income on whatever terms would be available at the time. That would include a requirement for you to have at least 10% equity in the property. You should also get Child Support from the father.

    You will need a solicitor and should be able to get advice there which would be more relevant to your actual circumstances.

    Thank you for your advice and apologies for misspelling (shool).

    Life's tough as it is at the moment but my still husband wants me to suffer for something I haven't done.

    I have solicitors to help me get through this. I will try to get my name on the house so my daughter can benefit when she's older. Many thanks again and good luck to you too.

    If you pay the mortgage on your own you need to get the house into your sole name or he might be able to claim half the house when itis paid off.
