Ex asking for money paid towards house expense

HI

My ex partner lived at my house (mortgage in my name only) for approx 5 years. Paid nothing initially then around £130 per month towards bills only. Not long before they left (moved in with someone else) they had paid some money towards windows being renewed. When they left they asked for this back, I gave them all the money I had in savings but this was not the full amount they had paid. Now they have emailed me and asked for the rest (they left in October 2010). What is my legal position please?

    Replacement windows are usually an upgrade from what was there before so part of the cost is a capital cost which the owner should be liable for. However, part of the cost relates to wear & tear which the occupiers should be liable for. But only part of that would relate to the 5 years you were together.About 20% should be your partner's share.

    What did your partner pay for? You should jointly have been responsible for Council Tax, Water, Gas, Electricity, Food and a sum equivalent to the rent.

    Sumarise them all plus anything else you can think of. Halve it, or rather split it in proportion to your incomes as you were co-habiting. Then offset whatever your partner paid towards bills and whatever is left of the window cost that he/she had paid, after offsetting the 20% and whatever you have already repaid.

    Hopefully, that will result in an amount owed to you. You could pursue that amount or call it quits for the sake of a quiet life!

    I have assumed that there was never anything in writing to contradict what I have said.

    It is quite common for some bills to be paid by one partner and other bills to be paid by the other partner, rather than splitting everything down the middle. What I have suggested is to reconcile the differing payments to prove that you have already paid more than your fair share.

    If the reconciliation shows that you do actually owe some more, at least it would be substantially lower than has been requested.

    Thank you, there was nothing in writing, and he never paid anything equivalent to rent, only the extra 25% council tax and a small amount towards bills (£130 per month total). He put a number of items on a joint credit card (including all his fuel) which he never paid for. The windows cost £5000 and I paid £3000 back to him. I am certain that I should not pay him anything further taking into account what you have said regarding rent equivalent, and if I worked it all out he would owe me money, however I am not interested in that. I was worried if he could try and pursue me for the money and how I should respond. Many thanks for the advice it is much appreciated.
