I opened a current with the Royal Bank of Scotland year.

I became unemployed and couldn't afford their monthly fee so I asked them to cancel it. I returned my credit card to them and they refused to cancel unless I gave them £60.00. I refused and am now being hounded by them. I have never used this account, have paid nothing in and have withdrawn nothing. They are now threatening me with legal action for the fees that keep accumulating as they keep giving me overdrafts to cover the cost of the fees. Can anyone give me advice?

Have you tried to close the current account - you mentioned trying to close the Credit Card account?

Was there a minimum period in the terms and conditions?

The current account seems to be the priority.

Would the credit card still cost £60 to close if you used it? What would happen if you just leave it unused?

I don't know about the terms and conditions Mike, just that if I close the account I would have to pay £60.00. I gave them the VISA card back and had never used it. If I leave it unused they will keep on charging me the monthly fee and giving me overdrafts to cover the fees and the charges are accumulating at £6.00 daily.

I suggest going to see your local Citizens advice bureaux with all your statements and paperwork. They should be willing to write to the bank on your behalf. As you have described it this sounds very unreasonable.

Have you written a formal complaint to them this would be a good start. If they know the circumstances I can't see them being too keen to see a case like that go to court. I can't see a judge being particularly impressed with their behaviour.

    Your posts are confusing.

Credit Card. Was this the account that they wanted to charge you the £60 for? If so, what would happen if you just leave it alone? Would there be a Dormancy charge? You will have been supplied with Terms and Conditions.

Current account. You will have been supplied with Terms and Conditions for this also. Have you tried to close this account? What did they say if you did? Is there a minimum period? If they are charging you a monthly fee, presumably there are some perks attached which have to be paid for, even if you aren't making use of them. As long as the account is open, they are entitled to charge for those perks. You need to get that account closed as soon as possible in order to stop the monthly account charges. If you haven't been paying anything in, they would be entitled under the T&Cs to charge all sorts of other fees. Once the account has been closed you may be able to negotiate a reduced payment or time to pay, in your circumstances. If you can't then try the Financial Ombudsman Service.

Thanks for your good advice. This morning I discovered that they had suspended one of my other accounts and they put me in touch with their debt collectors. I told them that I would stop banking with them and they agreed to cancel all the charges and reduce the balance to 0.
