Can we get our reference fees back when we've been gazzumped?
Thursday before last we paid a holding deposit & reference fees for a flat we'd had an offer accepted on. The next day we sent over the forms for the referencing. This morning we found out the landlady had given the flat to someone else (who has moved in already!). The agent will give us our holding deposit back, but our references have been done. Are we able to get our money back? Or, are other agents likely to accept a reference we have obtained for another property (within the last 10 days)? Help! We're prepared to take the landlady to court for our loss of money. The agent has also lost money, their finder's fee.
