genuine oversight - will I go to jail. or be fined?

I have been struggling on incapacity benefits due to intensive surgery and my mum has been supporting me. We are now both in debt due to devaluation of pensions and savings and no income. I have found some forgotten shares, which were never to be cashed in and must now do so.Should I declare them? Although not officially disabled now I would be in too much pain to stack shelves in the supermarket for more than a day, but not too proud, like everyone else hanging on day to day

    How much are they worth?

The key thing is, when you filled in a benefits form, did you actually have savings including these shares of more than 6k?

If no, then it wouldn't have made any difference if you had declared them.

Apart from this question, it sounds like you and your mum both need some good debt advice. Can I suggest you post details of your current situation here: http://boards.fool.co.uk/Messages.asp?mid=11730174&bid=50079

There isn't enough room in jail for all the hard-core benefit cheats, so it is most unlikely for a genuine oversight.

Were they inherited or in trust?

Find out how much the shares are worth. We can help there if needed.
